Allaire Monticollo advises clients on state and federal privacy and security requirements and pending legislation and regulations. Allaire keeps a close eye on emerging legislation, tracking and analyzing the latest developments and advocating for clients in submissions to state legislatures, Congress, and federal and state agencies. She actively monitors developments under enacted omnibus privacy laws, new regulations, and issue-specific laws that address consumer health data, data brokers, geolocation information, and minors’ privacy. Allaire also engages with federal agencies, such as the Federal Trade Commission (FTC) and Consumer Financial Protection Bureau (CFPB), to help shape new requirements and advocate for clients.
Allaire also counsels trade associations and companies on privacy compliance and advocacy matters, state data breach notification laws, and international privacy and security requirements, including the General Data Protection Regulation (GDPR), Children’s Online Privacy Protection Act (COPPA), the Gramm-Leach-Bliley Act (GLBA), the Fair Credit Reporting Act (FCRA), and the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM).
In addition to advising on federal and state data privacy regulations, Allaire counsels clients on advertising self-regulatory principles and codes of conduct, including the Digital Advertising Alliance Self-Regulatory Principles and the Association of National Advertisers (ANA) Guidelines for Ethical Business Practice. Allaire has also assisted with government investigations by Congress and state attorneys general.
